Lg Chocolate Touch Purchased on Ebay

I purchased a Lg Chocolate Touch on Ebay and need to know if the folks left their contract can I use the phone on my contract with verizon?

would it matter if the previous person has a balance on the phone? I was just told their line was disconnected and still is unpaid.... would that interfere with activating the phone on my line?
