    Locking or unlocking make no difference how a carrier treats a handset. In fact, the carrier cannot tell whether a handset is locked or unlocked. A carrier will treat an unlocked handset they sold the same way they would a locked handset. What makes a difference is whether the handset is branded or unbranded.

    well that totally depends upon the mobile company, but Nokia asha 303 which is basically a messenger phone that is sold online comes with data plans, In India if you buy asha 303 from ebay then it comes with a free data plan from vodafone india for first three months and then with some discounted offers also, so you can get or try out one

    Careful with buying phones off Ebay though, you never know what your gonna get! (be it bad ESN, water damage temp fix, etc!)

    If I may suggest, since you mentioned that you want a phone that you can use for SMS, calling and music the strongest candidate I can think of right now is Sony Ericsson W995 since it's a walkman phone. Unless you want other features that a Smartphone can offer, the W995 will be the best choice

    You usually have to buy a data plan when the phone you are purchasing is a smartphone. The cheapest data plans that I would go for would probably be form Sprint or T-Mobile.

    I have At&t right now and paying $15 for just the data plan.

    If the phone is locked to T-mobile then you are most likely gonna need to get a plan. I recently bought an unlocked HTC HD7 from timtechs ebay and gave it as a present to my dad (my dad seems pretty happy with it). Just a friendly suggestion, do yourself a favor and don't tie yourself with all the carrier's restrictions, you will find that unlocked devices gives a you a lot of flexibility

    I am T-Mobile and the phone I'm buying is a T-Mobile as well.

    The answer to your question is dependent upon the rules of your carrier and how they treat that model phone. If your carrier is T-Mobile, they may apply their rules to the phone regardless as to how you acquired it. You should either check your carrier's website or call its customer service for information. Since you did not identify which carrier is involved, there is no definitve answer which covers all situations.
