A gag gift company is suing Microsoft for allegedly copying their ads. The popular Microsoft ads depict cell phone users that can't get off of their cell phone in the bathroom and in the bedroom. The company's fake product CellRDerm, a fake quit your cell phone remedy, made similar ads in 2009.

Here are the ads for CellRDerm:
[ame=http://www.youtube.com/watch?v=Sq4E_njDM4s]‪Are you pissed-off with cell phones? CELLRDERM - the best way to flush away their obsession!‬‏ - YouTube
[ame=http://www.youtube.com/watch?v=DlAZuQHpe4U]‪Is your cell phone breaking (you) up? CELLRDERM - Your #1 bedroom accessory!‬‏ - YouTube

And here's the Microsoft ads:
[ame=http://www.youtube.com/watch?v=7Z3KbFBf89Y]‪Bathroom Really Ad | Windows Phone 7 Official TV Commercial‬‏ - YouTube
[ame=http://www.youtube.com/watch?v=k6__UnrRSGo]‪Bedroom Really Ad | Windows Phone 7 Official TV Commercial‬‏ - YouTube

They are pretty similar ideas. What do you think? Is this copyright infringement?
