Is anyone recieving telemarketer's phone calls on their phones yet?
After the announcement of the Do Not Call list, I am starting to get
calls from people wanting to sell me things! I bet as soon as that
list goes into effect that our phones will blow up with them because
that will have no other people to call. I wonder if we can put our
cell numbers on the DNC list??

Cell phone numbers can go on the DNC list. And currently it is against
FCC regulations if an auto dialer is used to call a cellphone prefix.
Big fines if they get caught. - sheureka

my cell number has been my only number for about 3 years now. i get a
few calls now and again and i usually very impolitely tell them to go to
hell, eat **** and die, and inform them that they illegally called a
cell phone. they usually apologize and tell me that they will remove my
number from their list immediately.

I read an article that said that early responders to the DNC list
would be barraged with sales pitches until the very last minute before it
becomes punishable by law (which is November if I recall?).
Telemarketers are panicking, and they are assuming that those who
did not put their names on the list might not ever, so they are going after
the ones who have already. Last licks.

Thanks for the info, that is very intresting! I wonder if AOL knows
that the schmucks they hired to bug the hell out of people are calling
cell phones now? I'm going to inquire next time I get one. Maybe i'll
be able to nail their ass!
BTW, as if you didn't realize, one of the soliciting phone calls came
from someone representing AOL wanting me to try broadband.

And do these telemarketers actually believe we'll BUY something from
them after we've put our names on the list, and they barrage us with
calls until the very lest second? If it's true, then it sounds more
like they're just being malicious.
Unfortunately for them it'll backfire, as the stark contrast between the
barrage of telemarketing calls before the law kicks in and the lack
thereof after will only reinforce the need for such a list in people's
minds.

I've had my Sprint PCS phone since 12/30/1999, and just got my first
telemarketing call on it the other day. My PCS number is already on the
DNC list, so this certainly smells like telemarketer desperation and/or
revenge. I also listed my E-Fax and J-Fax numbers, neither of which has
the voicemail option, just for grins.
In the US, *ANY* telemarketing call to a cellphone, unless you have a
previous business relationship with the caller, is illegal under the
provisions of 47 USC 227 (shorthand for "Title 47, United States Code,
Chapter 5, Subchapter II, Part I, Section 227," which includes the
"junk fax" law but also prohibits certain telemarketing activities).
The same applies to toll-free numbers, on the same logic: you are (at
least potentially) paying to receive the unsolicited call.
It is illegal for a telemarketer to "cold call" using a pre-recorded
announcement, to any residential number. Any "cold calls" *must* be
introduced by a live person, and you must give your permission before
they can play a recorded announcement. That provision is widely
ignored, though.
The good news is that -- if you can identify the telemarketer or the
business being marketed -- you are entitled to $500 per call in
damages, up to $1,500 per call if you can show that the violation was
willful. If the telemarketer is a company of any size, the violation is
automatically willful if they called your cellphone, since it's trivial
to exclude all cellular prefixes from their calling database.
