According to [1], "To comply with FCC/IC regulations limiting both
maximum RF output power and human exposure to RF radiation, the
maximum antenna gain must not exceed 5 dBi in the Cellular band and 4
dBi in the PCS band.". On eBay, however, there are external antenna's
that go up as high as 13 dBi (for example, [2]). My question is...
are antennas that go up to 13dBi illegal to use? Are their health
considerations one ought to take into consideration when getting an
antenna whose gain is greater than 5 dBi?

No- the rules apply to the phone's built-in antenna.

Don't "deep throat" it?
The rules cover the phone's antenna because of it's proximity to your head.
Presumably you won't be wearing the external as a high-tech necktie, so I
wouldn't worry about it...
