I currently have a LG CU 515 phones. We have a xxx minutes, unlimted text,NO internet plan etc. If i were to have a factory unlocked AT&T Iphone 4, cut my exiting sim card to micro size sim & install in iphone 4, Will the iphone work for calling & texting as my LG 515 does now??? will it work all but the internet??

I can't say for 100%, but I'm pretty sure you HAVE to have a data plan.

yeah, I'm NOT sure either, But since org posting, I read where some HAVE done it, but some complain after a short while AT&T sent them a text saying there putting them with a data plan since there using a smart phone???... Then on the flip side I read AT&T can't legally do that if you NEVER renewed yr contract & its older then around Sept 2009???? I would like to lern more & know someone on these forums KNOWs the answers???

If you change your phone to a smartphone, a data plan is REQUIRED. The only way to avoid a data plan, is if you had the smartphone prior to the requirement and NEVER change. If you change to a new smartphone, then the plan is required. It makes no difference if you are in contract or out of contract. You change to a smartphone, the data plan will be automatically added. It is now in the terms of service.

A data plan has always been required for the iPhone on AT&T. The data plan requirements for other smartphones were added in the late summer of 2009. Those without a data paln at that time were allowed to get an exemption for that specific phone if requested by November of that year. If you then switched to any other phone, a smartphone data plan would be required when you next used a smartphone. This included switching from your current exempted smartphone to another smartphone except for warranty or insurance replacements.
The data plan requirement is not part of a contract. It is part of the Terms and Conditons and applies to each AT&T customer regardless of their contract status.
