    Class Action Law Suit Against Rogers...?

    When I purchased my "not so smart" cell phone (Rogers branded Blackberry junk) from the Rogers store on Queen and Woodbine in Toronto (don't ever go in there - they know nothing) in May of 2008, I was told in no uncertain terms I could upgrade the phone in a year when the iPhone became available in Canada - they insisted it wouldn't be out in 2008. Two weeks later the iPhone was introduced in Canada! They should be ashamed they even go to work in the morning...

    So I waited over a year to upgrade my phone (did I mention I'm an iPhone developer) because Rogers wouldn't let me change my phone. When I recently called (June 11, 2009) to see when I could upgrade to a new iPhone 3G S, Rogers informed me the policy has changed and I am out of luck again.

    On March 30th, 2009, Rogers changed their policy of allowing upgrading of smart phones from 1 change per year to 1 change every 2 years.

    As a result, I cannot buy an iPhone - not didn't want to - not won't pay for it - they just WON'T sell it to me. Are the Rogers people nuts??

    I am fed up and it's time to fight back and I'm not sitting on the phone and wasting time with Rogers uninformed employees.

    So if you are interested joining in forming a Class Action Law Suit against Rogers Communications regarding phone upgrades and contract issues please email me.

    Rogers doesn't care about anything but money so let's make them behave by hitting them in their wallet. Ted Rogers was an evil man and deserves no respect.

    I'm not familar with Roger's policies, but most companies will give you a discount on new phones at the end of contracts to encourage you to stay with them. It's not that they won't sell you a new phone, you just have to pay full price for a phone.

    How long was your contract? Did you have it in writing that you could get a discount on a new phone a year after signing a new contract?

    Thanks for your response.

    I am going to check my Rogers contract with an attorney in great detail but the simple fact is that it is not simply unacceptable to enact a new policy regarding upgrades as I have briefly described once two parties have entered into an agreement, it is actually illegal. They simply changed the policy - period. They are violating the agreement - period. They will try to get away with it because they are a big evil company - period. No I'm not crazy, I just demand to be a customer not a piece of meat.

    If there are others having contract issues with Rogers I would like to hear from them.

    I currently finished a 2 year contract with rogers. I saw that I could get a 16gb 3Gs for $199. on a three year contract. When I went to get one they told me because I'm a current customer I don't qualify for the posted price and would have to pay more. ???????? At first they wanted $550. for it. I politely asks the guy if he was high and left the store. I then called rogers, witch anyone who deals with them knows happens often and takes a while. The guy I talked to last after about 20 min. told me that in order to get the phone for 199 I'd have to add a line then cancel me current line and give up my phone. Probably with some bull crap cancelation fee. lol He then told me he could get me the phone for $275. + $35 admin fee. Out of principal I declined. How does this work? Does rogers really have a different price list for current customers not on contracts? Is every price they advertise in the store only for new customers? I feel like they just don't care. I think I'd be better off buying it outright and going to a different carrier when one comes out.
    Please let me know your thoughts on this.

    In my case, given my complaint Rogers changed the options after I signed a contract, the best advice I have received so far is to file a small claims court suit against Rogers Communications. I simply have to serve the papers to any Rogers employee and that's considered legal. If I do not get the results I want by the end of next week I will be filing such a small claims document - it's only like $75...

    I too am dismayed by the fact that Rogers won't take my money. It's astounding that I am basically saying, "Please sell me the most expensive cell phone ever created at the highest cell/data rates on the planet" and they won't. Rogers products and their service is sub-standard and managed by MBA's which in this case stands for "Massive Brain Abnormality"!

    I too am considering buying the phone outright just for the pleasure of telling Rogers to F#%! OFF.

    Hi Philly....I am having the same fight....over original contract that was signed 5 years ago and was only a 3 year contract. I cancelled service with them knowing full well I was out of my contract with them by 2 years. I recieved my final invoice and the devils have hit me with 2 $400 early termination penalty's....I am looking into class action AND I bet I am one of many out there trying to fight the same thing!

    Their response if tough luck...they won't do a thing and have me over a barrel because if it goes to collection, my credt is going to be ruined....

    Any suggestions????

    The best advice I so far is to file a small claims court suit against Rogers for say $800 for breech of your original contract. Serve it any Rogers employee or send it to their legal department's P.O.Box (these people have to hide behind P.O. Boxes like rats) and apparently you will get some response and it won't be bite me; the last thing Rogers wants is their day in court!

    I'm with you and if there is any way I can help in your fight please say so.

    I think an "I hate Rogers" day mash-up meeting in Dundas Square is calling me...

    Hey,
    ya i was misslead and signed with rogers.
    I asked around about the best way to have an international phone.
    They said to get a phone that unlocks.
    So asked TWO different rogers stores and they said it was ok and they do it all the time!!
    They said to put the contact on the lowest allowed monthy charge and then get a chip in Europe when i get there since i was going away for a couple months.
    So got a nice Blackberry signed my life away for 3 years!!
    Then they say no you can not unlock the phone. I am not a cell phone wiz but makes sense to unlock phones when travelling.
    Like save the environment! ....Why get a throw away pay as you go cell for a couple months??
    My question is will they void my contact if i find a way to unlock my phone.
    And how will they know i unlocked my phone??

    deal with the devil .

    I noticed that you posted that a while ago, but...... I really am pissed off at rogers and want to take action. HELP!!

    Short story: they told me one thing and did another and now they caught me and I'm hooked paying more money than before. I am a student and I just spent 1h and 20 mins speaking to them and even to a manager.

    This has happened many times before to me, It's bad.

    I had Rogers service and I could not get my cell on any cal for more than 5 seconds for over 6 months. There customer support had me put in new equipment on my phone - at my cost - still would not work. My sister who is developmentally disabled, required my assistance and I could not even dial 911 and keep the call - they would not let me out of the contract, nor even admit that there was a problem. I had to change providers as my sister's situation is on -going. I have a new provider - no issues - but Rogers sent my account to a bill collector who harrasses me all the time on all phone numbers.

    I want to sue rogers for breach of contract - lack of service and harrassment, yet they will never deal with you. If there is anyone else that had service issues during 2009 let me know - we only need 3 people to get a class action suit.

    And please SEND this link to everyone you know that has a cell phone! This CAN benefit all of us in Canada!

    I am also placing a lawsuit (tomorrow, September 5, 2012) against Rogers for charging me a $400 contract cancellation fee while I had no contract with them at the time when I cut my cable services with Rogers.
    Following that, I will likely do a public inquiry on finding out who else has been defrauded by Rogers.

    Someone stole my wife's identity. That person purchased a rogers phone contract in my wife's name, and we discovered it when we started receiving bills in the mail. We reported the matter to Rogers and the police; however, Rogers continues to bill us. My wife has written Rogers a letter warning them to cease the billing, or we will take legal action against them. The key issue here is that the billing now affects my wife's credit rating. Is there anyone out there with the same problem?
