In july, my galaxy S2 decided it had enough and died. I contacted T-mobile since I had insurance about a replacement and after a few days and no phone, i contacted T-mobile, and was told the S2 was on backorder which wasn't an option. I was then offered the S3 as a documented exchange. T-Mobile sent a long wordy email that stated that now I agree to an upgrade, which i didnt notice now, I have to pay 100's of dollars for a phone I didnt want, even tthough there is ample doc that it was an exchange

If you have insurance there is a deductible. Is the deductible $100? You shouldn't have to pay for an upgrade if they don't have your original phone and they provide the replacement. Regardless you still have to pay the deductible.
