    Hi,

I am currently having a major problem with phones4u (UK) and returning
my phone. Im hoping someone can give me some advice as to what to do
    next...

On 3rd June I signed a contract with phones4u for a voda contract and a
siemens benq ef81. I was porting my number from o2online and supplied
them with the PAC code on the 3rd. Due to their incompetent staff not
listening to me (I had a couple of midweek trips abroad), the port date
was eventually set at 22nd June. I did not receive a phone or a sim on
    the 3rd.

I went into the store on the 22nd and collected my new phone and
contract (sim activated on the 22nd with new number). Having played
with it for a few hours I deceided to return it (under their 14day
guarentee). However when visiting the store they said I cannot return
it as it is outwith the 14day guarentee (which they say started on the
    3rd!!!).

Several phonecalls later I had phones4u on the phone saying they could
cancel the contract. I also phone voda to see what their take on the
situation was- voda said contract started on the 22nd (commencement
date) and as such I have 14 days from the 22nd to cancel.
Unfortunately on returning to the phones4u store they changed their
minds and said it is now non-refundable despite what voda say (I spoke
to the store and area manager).

So at present I have phones4u saying I can't cancel and voda saying I
can (and voda are supplying me with my PAC code to terminate the
    contract).

I do not know what I can do with regards to phones4u now. I have a
phone from them that they will not take as a return despite voda
    agreeing to cancel this contract...

My main question is... If I receive the PAC code from voda and port my
number off, thus terminating the voda contract, what will happen? Will
phones4u still be able to bill me? Will they then request the phone
    back?

Does anyone have any other suggestions? I have spent all day today
(Saturday) going round in circles with phones4u and despite voda being
in complete agreement with myself I cannot seem to solve things with
    phones4u.

Should I just take the pack, cancel the contract and keep phone (or
    will phons4u kick up fuss?).

Sorry for the long email but its a tricky situation to explain. I hope
someone can give me some advice please!!!

    Thanks!

Take the PAC code, port your number, cancel your Direct Debit Keep the phone
and wait to see if P4U ask for it back

Take Vodafone's offer to cancel the contract, stop any relevant direct
debits at your bank and invite P4U in writing to collect the handset,
keeping a copy of the letter for yourself.

I imagine that P4U will not bother to collect, and you will end up
keeping the handset. I would keep the handset for a while before
deciding that it's "yours" and selling it, giving it away etc.

    No.

It's unlikely that the store would even know that you had cancelled your
contract, but keep the handset just in case. It's not like you haven't
tried to give it back is it!

You're probably going to hate this because it in no way helps your
situation, but I have to ask. As someone who is strongly considering the
BenQ-Siemens EF81 as an upgrade if and when CPW start stocking it, I'm
curious as to why you decided to return the phone.

I've previously used the Motorola V3 and, while I loved the physical
design of the handset and the glorious screen, frustrations with the
interface were just too much to cope with on a daily basis. External
buttons that were too easy to accidentally press, slow response times,
the need to set up shortcuts for options buried ridiculously deep in the
menus, and last but not least the awful implementation of predictive
text, meant I ended up giving the phone away.

(I'm currently using a Sony Ericsson Z520 which is a lovely phone, but I
really miss that big V3 screen!)

I was hoping that the EF81 might have been the answer. Similar enough in
build to the V3 but with, according to the limited reviews I've seen, a
    much more thoughtfully designed UI.

So, if you don't mind me asking, what was it that you (or indeed any
other readers with EF81 experience) found so objectionable about the
    handset?

Using the PAC is all well and good, but if P4U don't process a 14 day
return then Vodafone will send a bill with a cancellation charge for
the unbilled line rental to the end of the contract.

I would suggest talking to your local trading standards office. You
mention 'incompetent staff', you will need to be quite specific about
where agreements have been broken, for example you say that you signed
the contract on 3/6, did the contract specify an activation date? My
understanding is that the contract only commences from the point of
receipt of the goods or written confirmation, whichever is later.

Simply the act of involving trading standards may be enough to make them
    back-off.
