    Check the documents you signed with them when upgrading last year. If
    you ticked the box to opt-out of marketing contact, etc. then have them
    prosecuted under the Data Protection Act.

    Any company of which you are a customer is allowed to send you
    marketing information unless you have explicitly opted out. Since you've
    purchased something from this Orange shop, it's therefore not an illegal
    communication.

    The simplest solution is to contact them and ask them to remove you from
    their marketing list.

    That won't actually achieve anything. This was not an automated system
    sending the messages, it was a person with a phone. A person who already
    had a phone off them last year. All they are doing is going through
    last years paperwork and texting each customer once. The OP won't get
    that message again.
