But Alex, none of this shows that you are not spammers.
Did he request and then complete a 'confirmed' opt-in for the text
message you sent him?
If not, then you are guilty as charged.
Oh, and rule number 1 about spamming:
Never opt-out of something that you didn't opt-in to.

For anyone who received our marketing message, we do have the required
mobile originating "opt in" message. Therefore we are not spamming and
should anyone, including Spin Dryer, disagree with this we can provide
the date, time, number and content of the opt in message. The opt out
option is to opt out of receiving further marketing messages from us
and removal of the number from our database.
If you look at the web site, www.talki.me you will see that this is a
genuine offer for a product that can save you significant amounts of
money. Please feel free to try it and you will see that you are not
billed until such time as you opt in to become a subscriber and
authorize us to do so.
We stand behind our marketing and our product and can be contacted

I'm sure that's true. But if you're so customer friendly, why do you not
offer an 0800 or normal landline number instead of a revenue generating
0871 one?

What a load of Hogwash Slick, and you are pure liars with regard the
"opt in" message.
You did *not* answer the question about confirmed opt in.
Your spamming company sent text messages (2 in fact at about the same
time on two following nights 09/12 and 10/12).
You sent these "marketing" messages to mobile numbers that did not ask
for it - why did you do this ?
This is spamming, for which you will should be shut down.

numbers that did not ask for it. This is spamming.
What would happen if every spamming company did the same as you, how
many text messages do you think mobiles would receive? The end user's
mobile number would be swamped and effectively made unusable.

penalty and we never send out texts to mobiles where they have not
opted in to receive marketing messages or offers. To anyone who claims
that they were not part of an opt in database, send us your number
directly to our support email address (or simply text us back) and we
will make sure that you are removed from the database. This is a
requirement and we are following the regulations to the letter. The
real spammers are not traceable. I think that we have shown that we
are not faceless in taking the time to answer questions and posts such
as yours. Again, we would be more than happy to remove your number
from the list. Just send us a personal email and we will do that. I am
sure that you would not want to post your real identity or number to
this group as that would guarantee that you get spammed.

So, where does this opt in database come from? How do people opt in?
You haven't answered the question about why you use an 0871 number if
people need to phone you. If you are focused on customer service, surely
it should be a geographic or 0800 number. Yes, I know they can text....

So, presumably you have a record that Bob opted-in to your campaign
using a confirmed opt-in system and can provide him with a copy of
that record?
If you are using a confirmed opt-in system then you will have sent
Bob a text message and asked him to reply confirming his agreement
and you will have a record of that. Without that confirmation reply,
you would not add his number to your database.
If you do not have such a system then you are wide open to abuse,
and the accusation of abuse, and are therefore - effectively - spammers.

Telling you a mobile number for you to remove from a database, in
which it shouldn't exist in the first place is next to useless.
How do numbers even get on your list ?
What is to stop anyone putting anyone else's number into your website
to ask for text messages ?

Why is it on the list in the first place ? Why has a person got to pay
to be removed from a list they didn't ask to be put on ?
You sent two marketing text messages to a mobile number that didn't
ask for it. This is spamming, and nothing to say why they were being
sent. It is pure and total text spam.
