    When I bought my V551, it came with a demo of the game Bejeweled.
    Unfortunately, since the firmware that I flashed my phone with didn't
    include the game, it was lost after the upgrade.

    If it's not too much trouble, if someone reading this group still has
    the demo version of the game on your phone, could you pull a copy off
    your phone, zip it up and email it to me?

    Would it? Even if it's a demo version of the game, not the full
    version, which originally came with my phone in the first place? I
    think a case could be made for reasonable use under the circumstances.
    All I want to do is replace what was originally lost.

    How do we know that?

    The proper thing to do is to contact the copyright holder, in this case the
    game publisher, and ask for a copy of the demo.

    Well... I'll grant you that all you have to go on is my word.

    Look at it this way... If I was looking to break copyright or something
    like that, why would I ask for a demo version of a piece of software, when I
    could go to a warez group and request a complete, registered one.

    In fact, you could argue that my request for the demo is indicative of my
    intention of going through official channels and purchasing the game once
    it's on my phone, and that having the demo would ensure that the proper
    version gets installed when I select the "Buy this game" option within the
    game itself.

    Of course, this could all be part of an elaborate scheme to scam Jamdat out
    of a sale, but why would I bother going through the trouble?

    It was just a request. Do what you will with it. I could always go to
    Rogers Wireless and get them to reflash the phone with a branded copy of the
    firmware then try to eliminate the branding myself.

    But since all I want is the game, that would be even more trouble, and would
    likely cost me around $30 for their time.

    I hope this adequately explains my motives and intentions...

    I`m with you on this, I think the initial respondant had his head too
    far up his own ass.

    If I had it, i`d have been happy to send it to you - that`s what demos
    are for - the publishers WANT it to be distributed and played to
    encourage sales.

    To the OP, just go to any cellphone forum and do a search, you will either
    find it, or a link to it and more games, in someones signature or on the
    site itself. Or just try a different V551 flex file, one that includes
    games, ask where you got it if the flex has games, or read the description
    if it has one.

    John I usually side with you on these issues but isn't a demo version
    just that - a demo? The purpose is to get people hooked and pay for the
    full version. I really don't think they'd mind, particularly when he
    could just reflex and get it as part of the flex. After all, he could
    have requested the full version but didn't.

    As I wrote, it's a simple matter to request a copy of the demo version from
    the copyright holder. It the copyright holder really doesn't mind, then it
    will presumably provide it. The point is that even the demo is copyrighted,
    and that the copyright holder might well have reasons to restrict distribution
    of the demo. For example, the demo might have been produced under an
    exclusive arrangement with the hardware manufacturer that might have now
    expired.

    Let's say that what you're saying is true for just a second, and the demo
    was released under exclusive arrangement with the hardware manufacturer.
    Guess what? I have the hardware for which it was (hypothetically)
    produced, and through experimentation, erased the game. My options are to
    either go to Rogers Wireless, pay them $35 to reflash my phone with the
    firmware that originally came with the phone, which would severely limit my
    use of the phone since that firmware is Rogers specific, and I don't use
    their service, or I could ask a kind person with the *same* *phone* to send
    me a copy of the demo (not the registered copy of the software, as that'd be
    wrong). Since it costs $5.00 US to register Bejeweled with Jamdat, it'd be
    somewhat insane to spend $35 to get the demo, since it came with the bloody
    phone in the first place.

    Now... Seeing as the game is available for a few dozen phone models, plus
    two PDA operating systems, both in demo and registered forms, your argument
    of exclusivity holds no water.

    It's not necessarily that simple. Such licensing agreements typically specify
    a certain number of copies, and replacing your copy would be another copy.
    That's why, for example, if you contact certain hardware vendors for
    replacement of a CD with licensed 3rd party software, you may get assessed a
    significant replacement charge, or refused entirely.

    If in fact the copyright holder wanted the demo to be freely copied, then that
    would presumably be noted in the license, and I would expect the demo to be
    legitimately available for free download. As far as I can tell, neither is
    the case.

    To be clear, I have no idea what the licensing agreement is in this case, and
    I'm neither defending the law nor giving you legal advice -- I'm just giving
    you my understanding. You may wish to consult a qualified attorney for legal
    advice and/or give some feedback to your elected representative in Congress.

    There could actually be specific licenses covering all such devices.

    What holds no water is not even trying to get a copy legitimately, or simply

    Look through the games available here for the 551 to find Bejeweled.

    I can't agree with that, and I can say that an awful lot of software
    vendors don't either. Most all the vendors I know of will replace a lost
    or damaged copy of their software upon proof that the requestor had a
    legitimate copy, some free, some for a copying and shipping charge.
    If they considered replacement to be another copy, they'd charge for
    another copy.
