    A friend of mine just purchased an iPhone from the local ATT&T store (just
    converted from Cellular One). After activating the service, she discovered
    the phone is defective. It will not charge. A new external charger and cradle
    doesn't help. Clearly, the phone was defective out of the box. AT&T refuses
    to simply swap the phone, saying it goes against Apple's policy. They want to
    her ship it to Apple for repair, which will take a week (she needs a working
    cellphone now). She'd prefer to cancel her one-day old AT&T contract and go
    back to Cellular One, but they won't let her. Any suggestions?

    They have to let her go back- there is a 15- day trial period with the
    iPhone (any other on phone on the planet would be 30), during which it can
    be returned without penalty. Tell her to take it back and port back over
    to Cellular One.

    Go straight to your local police department and file a complaint with the
    cop handling consumer fraud. Ask him to accompany you to the ATT store
    to witness, for himself and the court, what they told you.

    I bet your friend will be going home with a brand new, WORKING iPhone,
    such as they are all hobbled up like a WebTV, in no time.

    I'm not telling you this as a joke. This is a serious violation of any
    state's consumer protection laws and a CRIME. It should be reported,
    immediately.

    Once you have a police witness and police report, any lawyer will have
    their asses in small claims court, and they know it....hence the change
    in attitude.

    As is turned out, she took an entire evening and drove 130 miles to the nearest
    Apple store, where they cheerfully replaced the bad battery.

    She said the Apple store treated her with the most respect. Cellular One and
    AT&T customer service were of no help.

    Anyway, she's now a happy iPhone user, albeit a little worn from the experience.

    Hmm...130 miles at 34c/mile = $44.20, double that to drive back. One day
    of her life wasted has got to be worth $300. Those free replacement
    batteries are kinda high!

    Larry,

    I agree. But, she really wanted a working iPhone right away. And, to her, it
    was worth the drive down and back. And, you know, I probably would have done
    the same thing, even though it doesn't make sense.
