Bad esn

I recently bought a Evo 4g with a bad ESN from craigslist. I have tried everything to get them to resolve the issue but they keep telling me that they do not owe a outstanding balance and the phone should be ok to activate. But when I call sprint, they tell me different. Sprint tells me that they do owe money and that they have to pay their balance before they can release the phone! I am not sure what I can do about this but its really got me irritated. Please help!!!!!!
