I don't know why I'm bothering but here goes...
You are truly an ass that is *****ing just to *****. If they had fixed your
phone and sent it back to you not only would you still be getting back a
REFURBISHED phone but it would have taken days if not weeks longer to get
the same phone back. You can go on and on about not having "your" phone
returned to you but either way it's refurbished.

You have no proof that the phone was used by someone else. It's very
possible that the phone was defective out of the box and was sent in for
repair and used as a warranty replacement. I just returned a Motorola V551
that had a flaky #4 button it was never used.

Do you also expect to be without that phone for 90 days? If Cingular
were to do this, you would have to exchange a loaner phone, then when
*your* phone was done, you'd have to exchange it again. You'd probably
have to pay a hefty surcharge if you put even a scratch on the loaner
phone, or if you put too many minutes into the life timer.
